Welcome to Faraway ("we," "our," or "us"). These Terms of Use ("Terms") govern your use of our mobile application (the "App") and any services provided through the App. By downloading, installing, or using the App, you agree to be bound by these Terms.Information we collect
Apple's Standard EULA
This App is licensed, not sold, to you. Your use of this App is subject to Apple's Standard Licensed Application End User License Agreement ("Standard EULA"), which is incorporated herein by reference. If there is any conflict between these Terms and Apple's Standard EULA, Apple's Standard EULA shall govern with respect to the licensing of the App itself.
Acceptance of Terms
By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use the App.
Description of service
Faraway is a mobile application that allows users to generate and customize soundscapes based on text prompts. The App provides both free and premium subscription features.
Account registration
To use certain features of the App, you must create an account. When you create an account, you agree to:
Provide accurate, current, and complete information
Maintain and update your account information as necessary
Maintain the security of your account credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account
Subscription services
Auto-renewable subscriptions
Faraway offers premium features through auto-renewable subscriptions ("Subscriptions"). By purchasing a Subscription, you agree to the following terms:
Subscription plans:
Premium monthly: $4.99 per month (US)
Subscription features:
25 prompts per month
Unlimited saves
Auto-renewal
Your Subscription will automatically renew at the end of each subscription period unless you cancel it at least 24 hours before the end of the current period. You will be charged the subscription fee to your Apple ID account at the confirmation of purchase.
How auto-renewal works:
Subscriptions automatically renew on the same day of the month (or year for annual subscriptions) as your original purchase
Your Apple ID account will be charged 24 hours before the renewal date
You will receive a notification before each renewal
The subscription will continue until you cancel it
Cancellation
You may cancel your Subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current subscription period, and you will continue to have access to premium features until the end of that period.
To cancel:
Open Settings on your iOS device
Tap [Your Name] → Subscriptions
Select Faraway
Tap Cancel Subscription
Important: Canceling your Subscription does not provide a refund for the current billing period. You will retain access to premium features until the end of the current subscription period.
Refunds
All purchases are final. Refunds are handled by Apple in accordance with Apple's refund policy. To request a refund:
Go to reportaproblem.apple.com
Sign in with your Apple ID
Select the purchase you want to refund
Follow the instructions to submit a refund request
We do not process refunds directly. All refund requests must be submitted through Apple.
Price Changes
We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. You will be notified of any price changes before they take effect.
Free Trial
If we offer a free trial period, it will be clearly indicated at the time of purchase. After the free trial expires, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
User Conduct
You agree not to:
Use the App for any illegal or unauthorized purpose
Violate any laws in your jurisdiction
Transmit any viruses, malware, or harmful code
Attempt to gain unauthorized access to the App or its systems
Interfere with or disrupt the App or servers
Use the App to generate content that is illegal, harmful, or violates the rights of others
Reverse engineer, decompile, or disassemble the App
Remove or alter any copyright, trademark, or other proprietary notices
Intellectual Property
The App and its content, including but not limited to text, graphics, logos, images, and software, are the property of Faraway or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use the App's content without our prior written permission.
Termination
We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including if you breach these Terms.
Upon termination:
Your right to use the App will immediately cease
You will lose access to your account and any content stored therein
We may delete your account and content at our discretion
Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
The App will be uninterrupted or error-free
Defects will be corrected
The App is free of viruses or other harmful components
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FARAWAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.
Indemnification
You agree to indemnify and hold harmless Faraway, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by:
Posting the updated Terms in the App
Updating the "Last Updated" date
Providing notice through the App or via email
Your continued use of the App after such changes constitutes your acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
Dispute Resolution
Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization], except where prohibited by law.

Apple-Specific Terms
The following terms apply specifically to users who download the App from the Apple App Store:
Acknowledgement: You acknowledge that these Terms are between you and Faraway, not Apple. Apple is not responsible for the App or its content.
Maintenance and Support: Faraway, not Apple, is responsible for providing maintenance and support services for the App.
Warranty: To the maximum extent permitted by law, Apple has no warranty obligations with respect to the App.
Intellectual Property Claims: If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App.
Product Claims: Any claims, losses, liabilities, damages, costs, or expenses attributable to any failure of the App to conform to any warranty will be Faraway's sole responsibility.
Third-Party Beneficiary: You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
